If you have time, you can attend in person. During your observation of either a trial, sentencing hearing or appeal, you will take detailed notes about what you observed in order to write a report. Your report will include three parts—expectation, observation and analysis. Part A of this assignment, expectations, is to be completed before you attend the court hearings. This assignment supports unit learning outcomes 3. LEARNING OUTCOMES 3: - describe and evaluate the Australian legal system including the respective roles of parliament, the executive and the courts - explain the doctrine of precedent and use it to evaluate the relative importance of judicial decisions - explain the law making and development functions of the courts - locate, interpret, evaluate and apply legislation to legal issues - conduct legal research and use the results of that research to recommend solutions to legal problems. You will need to contemplate your expectations of the hearing and write a 300-word report on these expectations. The following are questions to consider when writing about your expectations. - Who is the most active party in the courtroom? - Is the accused an active participant? - Does the judge address the accused directly? - How do the parties interact with each other? Are they courteous or are they confrontational? - What is the general tone of the interactions? When writing about your expectations, including an accurate descriiption of how you expect the hearing to play out. Try to think of any details you may expect of the behaviour of those in court—how people are speaking, acting and interacting. Most of us have a preconceived notion of how a courtroom is run which may come from movies or television—this assignment will give you a chance to write down all of your expectations.
